Rentmy Carpark Pty Ltd (the Company) are committed to providing you with the highest possible levels of customer service. As part of this commitment the Company treats the privacy of your personal information as a high priority issue. The following Privacy Policy provides the user with details of the measures we’ve taken to comply with the National Privacy Principles in the Commonwealth’s Privacy Act 1988. In doing so we outline the type of information that is collected by the Company, as well as how we use and protect that information.

By using this website the user consents to the collection, use, and disclosure of information pursuant to the terms of this Privacy Policy.

This Privacy Policy does not apply to third parties that may be linked with our website. Third party websites are responsible for the privacy of the information they collect and the user should contact them directly for details of their privacy policies.

We reserve the right, to modify or remove portions of this Privacy Policy at any time. Use of information that we gather now is subject to the Privacy Policy in effect at the time the information is used. Any amendments made to this Privacy Policy will be considered effective two weeks after the amendments are posted on the Rentmy Carpark website.

Information Collected

The Company collects personal information from users sufficient to enable the Company to perform the tasks you have requested of us. This information will vary depending upon whether you are a User (advertiser) or Visitor. This personal information will always be collected directly from you in a reasonably apparent manner, as we provide our services to you. If you do not provide the personal information the Company requests, it may not be able to provide you with the relevant service which you are requesting. The information collected may include (but not be limited by):

  • Name
  • Business details (including ABN, ACN, logos and website links)
  • Street address
  • Email address
  • Contact details
  • Property conditions
  • Photographs of property
  • Password details for exclusive use within the website
  • Feedback regarding our services

Generally the Company does not purposefully collect sensitive personal information.

The Company does not collect your financial details directly on our website. For Private Users financial details will always be collected by an external party (as nominated by the Company, and processed via a web link) sufficient to transact payment for advertising services. These details will not be held for future use on behalf of the Company. For Corporate Users, financial details may (upon mutual agreement) be kept by the Company, however they shall not under any circumstance be held upon the website.

Rentmy Carpark aims to make using our website as easy as possible. To this end we collect certain non-personal information from your computer that helps our web pages work better for you. All of this information is used for internal Company purposes only, to enable us to improve our services. This information may include:

  • Computer operating system
  • Internet browser identity
  • Domain name of internet service provider

When you visit our website, our web servers record anonymous information that assists us to improve the structure of our website and monitor its performance. This is information such as:

All personal information is held confidentially in a secure (see “Security”) database. For Users (advertisers), some of your personal information will be published in your advertisement. The extent of this information is controlled by the User to the extent that only that information which they want to disclose within the advertisement will be disclosed. Any such personal information included in an advertisement by the User becomes public information by its nature. It is the responsibility of the User to ensure that all details within the advertisement are current, correct and sufficient to render the advertisement useful to Visitors. The personal information contained within your advertisement is only available to Visitors of the website for the period during which your advertisement is active.

Your personal information is only accessible for alterations by you, or in exceptional circumstances (with consent) by an approved Rentmy Carpark employee or subcontractor. It is the User’s responsibility to ensure that their personal details on the website are current and correct.

Rentmy Carpark may share your email contact information with Rentmy (the Parent Company) and any subsidiaries of the Company or Parent Company, provided it is within Australia. To the extent that this may happen, the Privacy Policy (contained herein) of Rentmy Carpark shall override any Privacy Policies of other companies involved. This shared customer contact information is used to send the User (via email) updates about our Company, and promotional material from subsidiaries of the Company or Parent Company. All of these promotional email campaigns will give you the opportunity to decline receiving future emails. Campaigns from external unrelated companies will not occur as a result of this sharing of information.

Rentmy Carpark reserves the right to sell or distribute (in any manner the Company sees fit) the database of Parking Station ads, both past and present.

Disclosure

Generally your personal information will only be disclosed as required for us to perform the services you have requested of us.

In the event that the Company engages a third party to perform services which involve handling personal information, the third party will be subject to the same Privacy Policy obligations as the Company. The Company warrants that they will take reasonable steps to ensure the third party only uses this personal information for the purpose of providing the service you have requested of us.

The Company may disclose personal information when we believe in good faith that the law requires disclosure. This may be as a result of situations where we have good reason to believe that doing so is necessary to identify anyone who may be guilty of a criminal act.

The Company may use third parties to analyse usage statistics on our website. Such analysis is performed using non-personal information from your computer and server recorded anonymous information collected from our website. No personally identifiable information is collected from our website by these engaged third parties. The use of this aggregated statistical data is limited to use within the Company (or Parent Company) or their subsidiaries. Apart from the third parties engaged to analyse the statistical data, this information will not be distributed to other non-related third parties.

Any information posted freely by the User on their ad, or our website advertisement forums, or communicated in third party chat areas or forums becomes public information by its nature. The Company can not guarantee the security of any information you disclose in these areas.

Security

Whilst the Company will take all reasonable measures to ensure the security of information submitted to our website, no data transmission over the internet can be guaranteed to be completely secure. However, once we do receive your transmission, we will ensure all the collected personal information is stored in a secure server with password protected access only available to authorised personnel, as per industry standard.

The Company makes no warranties with regard to the adequacy of these security measures. We shall not be responsible for any actual or consequential damages that result from a lapse in compliance with this Privacy Policy as a result of a security breach, technical malfunction or unlawful act by an individual.

You are responsible for the security of your username and password. As your primary defence against the disclosure of your personal information, you need to strongly safe guard your username and password, and under no circumstances disclose these details to a third party.

Access to Personal Information

A User can access or amend all personal information that we hold on them by logging onto our system and using their username and password.

For Visitors to the site, the Company stores no personal information unless they have made a request to be notified of a change in future service availability. In this case the only personal information we hold is their email address. In the event that a Visitor wants to edit or delete this information they should contact the Company (see below). Alternatively they can unsubscribe when they receive a notification via email.

Definitions

Carpark: Means parking or storage for cars, trucks, motor cycles, boats or any other vehicle. For the purposes of this agreement it also includes general storage of items other than vehicles.

Corporate (User): Means a Person whose primary business is that of running a Carpark (within the definition of this agreement). Note that a Person to whom income from Carparking is not their primary source, may still be deemed to be a Corporate User with respect to their dealings with the Company. The Company reserves the absolute right to determine whether a User’s status is Corporate or Private.

Company: Means Rentmy Carpark Pty Ltd.

Parking Station: A Carpark operated by a Corporate User.

Person: Means an individual, sole trader, partnership, agent, corporation or other legal entity.

Private (User): Means a Person to whom the business of running a Carpark (within the definition of this agreement) is a secondary consideration. Note that a Person to whom income from Carparking is their primary source of income, may still be deemed to be a Private User with respect to their dealings with the Company. The Company reserves the absolute right to determine whether a User’s status is Corporate or Private.

User: Means the Person placing the advertisement. By definition a User will have a secure account (homepage) within the website, which they control.

Visitor: Means the Person who is perusing the advertisements with the aim of finding a suitable User with which to enter into a business transaction. This Person is transient with respect to the website and has no website presence in that they do not have a secure account.
